The Law firm TOTUM acted as a legal advisor and defended the interests of the client - Recreation complex "Dniprovska Riviera", which is one of the leading companies in the restaurant business, in a dispute with the Kyiv city prosecutor's office about the cancellation of the Kyiv city council's decision to grant the Recreation complex"Dniprovska Riviera" the land plot located in the Holosiivskyi district of the city of Kiev and the invalidation of the leasehold agreement of the latter.

The abovementioned dispute, initiated by the Prosecutor's Office of the city of Kiev in the interests of the state represented by the State Land Resources Agency of Ukraine, was repeatedly heard by the economic courts of all instances, and the final decision was made by the Supreme Economic Court of Ukraine, which supported the decision of the Economic Court of Kyiv to refuse to satisfy the claim because of the missing by the plaintiff of the limitation period and the absence of valid reasons for its resumption, since over 8 years had passed from the date of adoption of the contested Kyiv city council’s decision and the conclusion of the debated contract of sale/purchase of land plot till the date of filing claim by the prosecutor's office of Kiev, and the applicant had not provided any explanation concerning valid reasons for missing the term of limitation.
