The lawyers of the practice "Settlement of Disputes" successfully defended the interests of the client

The lawyers of the practice "Settlement of Disputes" successfully defended the interests of the client - Creative Architectural Studio "Architecta" in a dispute with the Kyiv City Council and Public Corporation "Trust Kyivmiskbud-1" about the right to use the land plot in the Obolonsky district of the city of Kiev.

The dispute was adjudicated by the Economic Court of Kyiv, which supported the arguments of the Law Firm and found that Public Corporation "Trust Kyivmiskbud-1" did not acquire the title to the land plot on the basis of the contract of sale/purchase of the land plot previously concluded with the Kyiv City Council, and also found that as a result of the acquisition by the LLC "Creative Architectural Studio "Architecta" of immovable property on the disputed land plot, the company based on Art. 120 of the Land Code of Ukraine and Art. 377 of the Civil Code of Ukraine acquired the right to use the land, in connection with which the court sustained the claim, terminated the contract of sale/purchase of the land plot concluded between Public Corporation "Trest Kyivmiskbud-1" and the Kyiv City Council, and recognized LLC "Creative Architectural Studio "Architecta" to have the right to use the land plot.

The award by the Economic Court of Kyiv was upheld by the Kyiv Economic Court of Appeal and the Higher Economic Court of Ukraine.
